1. Acceptance & Agreement to Terms
By downloading, installing, accessing, or using the Yarn mobile application (“Yarn App”) or related services, you agree to be legally bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Yarn App.
2. Right to Modify or Amend Terms at Any Time
Yarn Health reserves the right, at its sole discretion, to modify, update, replace, or revise these Terms at any time.
Changes will become effective immediately upon posting the updated Terms on our website (https://yarn.health/terms) or within the Yarn App. Your continued access to or use of the Yarn App following the posting of any changes constitutes your binding acceptance of such modifications. It is your responsibility to check these Terms periodically for updates.
3. Non-Medical & Wellness Disclaimer (Critical)
Important Legal Notice
Yarn is an AI-powered tool intended solely for personal voice journaling, self-reflection, and general wellness tracking.
1. NO MEDICAL DIAGNOSIS OR CLINICAL ADVICE:
Yarn is NOT a medical device, clinical tool, or licensed medical provider. It does NOT provide medical diagnosis, clinical advice, psychiatric treatment, or therapy.
2. MUST NOT BE USED FOR EMERGENCY OR CLINICAL CARE:
Yarn MUST NOT be used as a substitute for professional medical advice, diagnosis, or clinical care.
3. CONSULT LICENSED PROFESSIONALS:
Always consult a qualified healthcare professional regarding any medical questions, symptoms, or conditions. In a medical or mental health emergency, immediately contact emergency services (e.g., 911 or 999).
4. Right to Modify, Suspend, or Discontinue Services
Yarn Health reserves the right to modify, suspend, restrict, or discontinue any aspect, feature, database, or service of the Yarn App at any time, with or without prior notice, and without liability to you or any third party.
5. User Content, License Grant & AI Model Training
- Ownership: You retain ownership of your original voice recordings and written notes (“User Content”).
- License Grant & AI Model Training: By submitting, recording, creating, or uploading User Content or interacting with the Yarn App, you grant Yarn Health a perpetual, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to host, store, reproduce, process, adapt, translate, publish, analyze, and use such content and interaction data for:
- The operation, improvement, feature expansion, and maintenance of the Yarn App.
- Training, fine-tuning, evaluating, testing, and developing artificial intelligence (AI) models, machine learning algorithms, natural language processing tools, and related technologies.
- General product R&D and business offerings.
6. Business Transfers & Corporate Reorganization
In the event of a merger, acquisition, corporate restructuring, reorganization, sale of assets, equity investment, or financing transaction involving Yarn Health, your account, User Content, and data may be transferred, assigned, or shared with investors, acquirers, or corporate successors without additional consent.
7. Account Registration & User Security
- You must provide accurate registration information and keep your credentials secure.
- You are solely responsible for all activities occurring under your account.
- You agree to notify us immediately at hello@yarn.health of any security breach or unauthorized access.
8. Acceptable Use & Prohibited Conduct
You agree not to:
- Use the app for any illegal, unauthorized, or fraudulent purpose.
- Reverse-engineer, decompile, or attempt to extract source code or underlying algorithms.
- Interfere with or disrupt the performance, servers, or security of the Yarn App.
- Upload viruses, malware, or destructive code.
9. Disclaimer of Warranties & Limitation of Liability
- DISCLAIMER OF WARRANTIES: THE YARN APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YARN HEALTH AND ITS DIRECTORS, OFFICERS, EMPLOYEES, INVESTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, HEALTH DECISIONS, OR PROFIT ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP.
10. Indemnification
You agree to defend, indemnify, and hold harmless Yarn Health, its affiliates, investors, officers, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Yarn App or violation of these Terms.
11. Apple App Store EULA Terms
If accessed via Apple iOS devices, the standard Apple Licensed Application End User License Agreement (EULA) applies in addition to these Terms. Apple is not responsible for the Yarn App or its content.
